Currently, there are no legal restrictions on having a citizenship other than Polish. A Polish citizen may therefore simultaneously be a citizen of another, or even many other countries. It is up to his or her will as to which passport he or she will use in a given circumstance - with the proviso that, from the point of view of Polish law, he or she is first and foremost a citizen of Poland, with all the associated obligations and rights.

    Ways of acquiring Polish citizenship

    By operation of law - which applies to persons having a parent/parent with Polish citizenship on the date of birth of the child

    Acquiring Polish citizenship by operation of law is connected with being born into a family in which at least one parent has Polish citizenship - in accordance with the so-called blood rule (ius sangunis). Apart from this case, Polish citizenship is also acquired by adoption (adoption), repatriation and in the case of a child whose parents are unknown being born or found on the territory of Poland.

    By vesting - what any foreigner can apply for

    Polish citizenship may be granted at the request of a foreigner, addressed to the President of the Republic of Poland and submitted through a voivode or consul. It is obtained on the date of the President's decision on granting Polish citizenship.

    By recognition as a Polish citizen - which may be applied for by a foreigner already residing in Poland for a certain period of time

    The basic prerequisite for recognising a foreigner as a Polish citizen is his/her legal, uninterrupted stay - for the period specified in the Act - on the territory of Poland. The residence is considered „uninterrupted” if none of the breaks was longer than 6 months, and their total duration did not exceed 10 months as a rule 2 . Depending on the specific case, this period must be at least: - 10 years for a person who has a permanent and regular source of income in Poland, a legal title to occupy a dwelling and who holds - on the date of applying for recognition as a citizen - a permanent residence permit, an EU long-term resident permit or a permanent residence permit; - 3 years for a person who has a regular source of income and a legal title to dwelling in Poland, for the entire period required (i.e. 3 years), - 2 years for a person who has been married for at least 3 years to a Polish citizen or has the status of a refugee, - 1 year for a person who, in connection with Polish ancestry or a Pole's Card held, has obtained a permanent residence permit. A foreigner applying for recognition as a Polish citizen must know Polish at least at B1 level - which must be documented. The Act provides for separate requirements for recognition of a minor as a Polish citizen.

    By restoration of Polish citizenship - this case concerns persons who lost Polish citizenship before 1 January 1999.

    A person who lost Polish citizenship before 1 January 1999 may regain it at his/her request. According to the previously applicable laws, the loss of citizenship could result from, inter alia: - performing public or military service of another state, - acquisition of foreign citizenship, - illegal leaving the Polish State after 9 May 1945, - evading military duty, - renunciation of citizenship Obstacles to restoration of Polish citizenship are: - voluntary joining the armies of the Axis States - acceptance of public office in the Axis States - acting to the detriment of Poland - participation in human rights violations - posing a threat to state defence, security or public order. Such a person obtains citizenship from the date of the decision on reinstatement - such a decision therefore has no retroactive effect.
