FAMILY LAW
The law firm has many years of experience in dealing with cases in the broad field of family law. For years we have been representing our clients in divorce cases, assisting in disputes over alimony, regulating contact with children or parental authority. An important part of our services is legal assistance in cases concerning the division of joint property of former spouses. The mutually complementary knowledge and experience of the attorneys assembled in the firm provides professional assistance also in complex cases of division of property when it includes real estate, companies or enterprises.
Falls
We provide legal assistance aimed at the comprehensive settlement of succession matters. We suggest the most favourable solutions for those who intend to draw up a will. We analyse the legal situation following the death of the testator. On many occasions, we have represented our clients in succession cases, particularly when the validity of the will is in dispute, making use of our extensive knowledge of criminal law where necessary. We have extensive experience in cross-border succession cases. We have represented our clients in numerous succession cases, in particular those involving real estate, including multi-tenanted townhouses. Within the scope of our practice, we have assisted many clients in litigation over conservatorship. When representing the plaintiff in these, we have always taken care to ensure that the claims asserted are properly secured in order to ensure effective enforcement.
real estate and reprivatisation
For years, we have been meeting the expectations of our clients in terms of legal assistance related to real estate. Being aware of their needs, we constantly cooperate with real estate appraisers, managers, administrators and real estate agents. As a result, we provide a wide range of services. We examine the legal status of the real estate, if necessary regularising it, in particular in the process of reconciliation of the contents of the land and mortgage register with the actual legal status. We prepare and give an opinion on agreements concerning real estate. We pursue claims arising therefrom, as well as the so-called supplementary claims (including for non-contractual use of real estate). We handle eviction cases effectively, ensuring that the premises are vacated as quickly as possible. On many occasions we have represented our clients in cases involving the abolition of co-ownership of real estate, including multi-tenant tenements. We have extensive experience in cases of acquisitive prescription, enfranchisement and demarcation.
A significant part of the Firm's practice is devoted to providing comprehensive legal assistance to clients permanently residing abroad but owning real estate in Poland. It is also on their authority that the Law Firm has conducted many reprivatisation cases, recovering real estate illegally taken over by the State Treasury after the Second World War and obtaining compensation on this account.
Civic affairs
The firm has considerable experience in cases concerning Polish citizenship, the possession of which has been equivalent to EU citizenship since 1 May 2004, following Poland's accession to the European Union. In particular, we represent clients in cases concerning confirmation of Polish citizenship, restoration of Polish citizenship, recognition of Polish citizenship and granting of Polish citizenship by the President of the Republic of Poland.
The Law Firm's long-standing experience in the field of civil cases enables the efficient conduct of proceedings, even in the situation of complicated facts, requiring, among other things, the search for documents in Polish and foreign archives, or the transcription of foreign civil status records. If such a need arises, the Law Firm immediately organises the translation of foreign documents, which is made possible by constant cooperation with sworn translators (including Hebrew translators).
An important scope of this specialisation of the Law Firm is cases conducted for clients who, due to leaving the territory of Poland during or after the Second World War, lost their Polish citizenship, as well as their children.
contract law and commercial contracts
As part of this specialisation, the Firm drafts contracts and reviews the agreements to be concluded by our clients. We analyse the consequences that may arise from entering into a given obligation and advise on optimal solutions. We participate in negotiations and negotiations prior to the conclusion of the contract, as well as those concerning problems arising during its execution. On many occasions, we have been involved in transactions involving real estate, always ensuring that our clients' interests are protected to the fullest extent possible. The firm also has significant experience in the effective enforcement of contractual claims, including in particular contractual penalties.
Criminal law
A significant part of the Law Firm's practice is the provision of legal assistance in cases in the broad field of criminal law. The Law Firm's team includes attorneys who for years have successfully represented the interests of clients in criminal cases, criminal-economic cases, criminal- fiscal cases or at the stage of executive proceedings.
In criminal cases, we act both as a defence counsel for the accused (at the stage of pre-trial proceedings - the suspect), as well as a representative of the persons who have been the victims of a criminal offence (auxiliary accusers) for their proper representation and the assertion of claims to which they are entitled. We provide legal assistance at all stages of proceedings. From its inception, i.e. pre-trial proceedings, through two-instance court proceedings, up to the enforcement of the judgment.
We pay particular attention to the pre-trial stage. It is there that taking the right stand, making the right decision often determines the fate of further proceedings in the case, determines the success or failure in achieving the intended goal. When representing clients, we always thoroughly analyse the case, taking into account all its aspects. We act in a well-considered manner, taking into account the civil law consequences of a given event, which guarantees the minimisation of consequences (on the part of the perpetrator) and, on the other hand, ensures the exercise of full claims (for the victim of a crime).
medical malpractice cases
The law firm has extensive experience in medical malpractice cases. For years, we have acted in them as defence counsel for doctors accused of committing a criminal offence (usually an offence under Article 160 § 3 of the Code of Criminal Procedure or 155 of the Code of Criminal Procedure). Thanks to the fact that the law firm also includes specialists in civil law, when representing our clients in criminal cases we always take into account the civil law consequences that may arise from the event in question.
On a number of occasions, we have also represented doctors in civil cases where they have been sued for compensation or damages.
disciplinary proceedings
For many years, the Firm has been assisting defendants accused of disciplinary offences before the disciplinary courts of the professional self-governing bodies. We have acted as defence counsel for accused judges, notaries, attorneys, doctors, or legal counsels. The Firm's professional legal assistance in this area is ensured by a working knowledge of criminal procedure and experience gained in the courtroom in a number of disciplinary and criminal cases.
Social security law
(cases against ZUS/KRUS)
We handle cases involving complex social insurance law, offering support wherever a citizen faces the clerical machinery of the pension authorities. We represent our clients in disputes over the granting of benefits from the Social Insurance Institution (e.g. total and partial disability benefits, social pension, survivor's pension, rehabilitation benefit), bridging pensions and verification of the amount of initial capital.
An important part of the services we provide is assistance in obtaining accident, sickness and support benefits, as well as defence in cases for the reimbursement of unduly collected benefits. Our complementary legal and procedural knowledge allows us to successfully appear before Labour and Social Insurance Courts, the Social Insurance Institution and Disability Assessment Boards.
We also provide expert assistance in complex entrepreneurial cases involving audits of contributors, challenges to the basis of insurance assessment or allegations of sham employment.
